Oral Argument at OSHRC
WASHINGTON, D.C. - On Friday, October 13, 2006 at 10:30 a.m., the Occupational Safety and Health Review Commission will hear an Oral Argument in the case of Summit Contractors, Inc. The argument will take place in the Review Commission's hearing room in Washington, D.C., located at One Lafayette Centre - 1120 20th Street, NW on the 9th Floor.
The Oral Argument will cover two cases involving citations from the Secretary of Labor against Summit Contractors, Inc. (OSHRC Docket No. 03-1622 and OSHRC Docket No. 05-0839) and address many issues, including whether to uphold the Multi-Employer Worksite Doctrine, implemented in Grossman Steel & Aluminum Corp. (No. 12775, 1976).
In both dockets, Summit was the general contractor overseeing construction projects. Summit has argued that in neither case did it create or have its own employees exposed to the cited conditions. The two cases have been consolidated for the purposes of the Oral Argument only. Each party will have 30 minutes to present its argument, and the Respondent (Summit Contractors, Inc.) will argue first, followed by the Counsel to the Secretary of Labor.
